Thomas Cardwell & Obedience Thweatt of Dinwiddie & Halifax Counties, VA
by Rand Cardwell - 31OCT03 updated 30Aug2007

Thomas Cardwell died in Dinwiddie County, Virginia prior to 1789. It appears that he was married to Obedience Thweatt, the daughter of Henry Thweatt. They were the executors of his estate. The children of Thomas Cardwell and Obedience Thweatt are established in the following record. Dinwiddie County, Virginia Court Abstract; William & Mary Quarterly, Vol. 3, No. 3, page 216: 1789 “William Cardwell, Henry Cardwell, Jane Cardwell & Elizabeth Cardwell, Infants of Thomas Cardwell, dec’d, by the said William, their next friend, complt. agt. Henry Thweatt & Obedience Cardwell, exors. of Thomas Cardwell, dec’d in chancery.” This record clearly states the children of Thomas Cardwell, but raises questions. It appears that William Cardwell, apparent oldest child, and Henry, Jane and Elizabeth are suing Henry Thweatt and Obedience Cardwell over the estate of their father. Additional research is needed to determine the extent of this family suit and its outcome.

There appears to have been other problems concerning the estate of Thomas Cardwell. From the Dinwiddie County, Virginia Court Order Books, page 79 : “Them. Scott and Peter Eppes defendants vs Henry Thweatt and Obedience Cardwell Executors of Thom. Cardwell deceased -–plaintiffs Aug. 1789.” This indicates additional court action in relation to Thomas Cardwell’s estate. Additional research is needed to clarify these cases.

An examination of the following theory needs to be considered. In the above mentioned lawsuit the children of Thomas Cardwell, deceased, are identified. William Cardwell, Henry Cardwell, Jane Cardwell and Elizabeth Cardwell are all listed as his children. They would have been born prior to his death, the last child possible afterwards, and were under twenty-one at that time. William Cardwell, from the language of this record, appears to be the oldest of the children that are mentioned. This compiler has not established the birth years of daughters Elizabeth and Jane. Consider that Thomas Cardwell, the son of Richard Cardwell and Susannah LeGrand, was born in 1761 and died, according to his mother's deposition in Charlotte County, VA Court, in 1780 was nineteen years old at the time of his death. Henry Cardwell, born in 1771 that is listed as a child of Thomas Cardwell by Pendergraft, can not be his child. If Thomas Cardwell were his father he would have been ten years old when he sired him! That brings up the following theory.

It is my opinion that Obedience Thweatt Cardwell, wife of Thomas, did not remarry to his brother or presumed brother. Daniel Cardwell’s wife, Obedience, has been confused with Obedience Thweatt Cardwell by researchers for years. This information requires additional research, but it is fairly obvious that Obedience Thweatt Cardwell, wife of Thomas, had only four Cardwell children. That she lived with her father, Henry Thweatt of Dinwiddie County, Virginia, until her death or until she remarried, which it appears that she did not.

Obedience Thweatt Cardwell, wife of Thomas, appears to have lived near her father, Henry Thweatt, after the death of Thomas. Henry Thweatt served with Obedience as an executor of Thomas Cardwell’s estate after his death in 1788 according to Dinwiddie County, Virginia records. Obedience Thweatt Cardwell bought 80 acres of land on Difficult Creek in Halifax County, Virginia on September 23, 1799. Halifax County, Virginia Deed Book ‘Q”, page 210: (From Abstract) “Obedience Cardwell bought 80 acres on Difficult Creek adj. Thomas Sparrow, William Cardwell. Wit. William Cardwell, George Seymour. – Sept. 23, 1799” William Cardwell is likely her oldest son from Thomas. It appears that Obedience Thweatt Cardwell lived in Halifax County, Virginia after moving from Dinwiddie County, Virginia in about 1795.

Naming Trends: One of the major clues in researching families is the naming trends that are utilized in various lines. For instance, the lines that stem from Thomas Cardwell and Martha Perrin use her maiden name as a given name. While researching it is fairly easy to determine someone from that line if the given name of Perrin is used. The children of Thomas Cardwell and Obedience Thweatt have naming trends that are different than those of the Thomas Cardwell/Martha Perrin line. Their oldest known son is named William. This may indicate the name of the paternal grandfather and is fairly common in early Virginia families. The second oldest son is named Henry. This indicates the name of the maternal grandfather. In this case it does perfectly. Henry Thweatt is the father of Obedience. The oldest daughter is named Jane and this can indicate the paternal grandmother. In this case it is Jane. If that is correct then the parents of Thomas were William and Jane Cardwell. Does that reflect any of the known Cardwell families of Virginia in the early 1700s? As a matter of fact it does! There is a William and Jane Cardwell that are mentioned in the records of the Parish Register of Christ Church – Middlesex County, Virginia 1653-1812; Genealogical Publishing Co., Inc. – 1975. According to that source the couple had the following children: Mary Cardwell – born in 1721; William Cardwell – born in 1723; Thomas Cardwell – born in 1726; Jane Cardwell – born in 1728. (see article on the Middlesex and King & Queen County, Va Cardwell families) Notice the naming trends and how they are repeated in the naming of the children of Thomas Cardwell and Obedience Thweatt. It is possible that Thomas Cardwell was the son of William and Jane Cardwell that was born in 1726. This appears to be a little unlikely since he would have been fathered his children starting when he was forty-five years old. It is likely that the Thomas Cardwell that married Obedience Thweatt was the grandson of William and Jane Cardwell. His father could have been either William or Thomas. More research is needed on this line, but this is the most recent findings concerning this branch and avoids the pitfalls of Pendergraft's research.

DNA Testing - Recent results in the Cardwell DNA Project indicate that Thomas of Dinwiddie is not related to the Thomas Cardwell/Martha Perrin line. He is more closely associated with Thomas Cardwell of Granville County, North Carolina. The parents of both of these Cardwell family patriarchs are still unknown. Hopefully, additional results in the DNA Project will help to solve these mysteries. We have the DNA test results for one individual in this line, but need others to add to the database. The Children of Thomas Cardwell and Obedience Thweatt

1. William Cardwell - was born on Dec. 14, 1767 in Virginia according to the records of Robert Buntin, a descendant of William's daughter, Fanny. He is listed in the Dinwiddie County Court Records that pertain to his father's estate, it is assumed that he is the oldest of the children. William was the son of Thomas Cardwell and Obedience Thweatt. William Cardwell is established as a son of Thomas in the 1789 Court proceedings, in Dinwiddie County, Virginia, in which he and his siblings (Henry, Elizabeth and Jane) filed suit against Henry Thweatt and Obedience Cardwell, the executors of his father’s estate. The reasons and outcome of that action requires additional research, but the record establishes some of the children of Thomas Cardwell. William Cardwell appears to have lived in Dinwiddie County, Virginia with his mother and grandfather, Henry Thweatt. It appears that William Cardwell bought 50 acres of land in Halifax County, Virginia in 1795. William Cardwell married Elizabeth Hankla, sister of Henry Cardwell's wife, Mary Hankla, on Dec. 15, 1791 in Halifax County, VA. Giles Cardwell is found in the records of Halifax County, VA appears to be a son of this William, but again this is NEW research and needs more work. Check back for updates! NEW - William Cardwell had a daughter named Fanny Cardwell that married William Buntin on Dec. 24, 1811 in Halifax County, VA. See specifics below.

William Cardwell is reported to have died on July 30, 1837 in Coffeeville, Yalobusha County, Mississippi according to information from Robert Buntin, a descendant. Fanny and William had several children and they will be added to this list as more research is conducted. From the Early History of Coffeyville - "About that time Wm. Buntin with his wife, several stalwart sons and comely daughters, his wagons, household goods, livestock and Negro slaves, passed Rayburn's store, ended their long over-land journey from Virginia on one of the adjacent hills. Pretty soon young Rayburn married one of the comely daughters." William Buntin died in 1855 in Coffeeville, Yalobusha County, Mississippi.

According to Allen Pendergraft’s The Cardwells of Virginia Elisha Cardwell was thirty-one when the Civil War began. He was not well and was rejected from service when he attempted to enlist in the Confederate Army. He was in danger of being impressed into the Union Army and as was practice those that refused were shot. Elisha escaped by hiding in a briar patch that he crawled into using a concealed rabbit trail. Several times the Yankees came looking for him, but each time the slaves would warn him and he would return to his hiding place. They migrated to Stoddard County, Missouri where he died in 1879. Check back for upcoming information on this branch. 29Aug2007

    B. Elizabeth Cardwell – she was the daughter of Henry Cardwell, Sr. and Mary Hankla. She was born about 1800 in Halifax County, Virginia. Elizabeth married Banister Wilkes, Jr. on October 13, 1819. Banister Wilkes, Jr. was the son of Banister Wilkes, Sr. (Revolutionary War Veteran) and Sarah (Last Name Unknown). Banister Wilkes, Sr. died in 1816 in Halifax County, VA. He appears to be the brother of John Wilkes that married Martha Cardwell in 1817 in Halifax County, Virginia (see below). Elizabeth Cardwel and Banister Wilkes had the following children according to wills that were presented to Halifax County Court in 1866:

      i. Banister Wilkes III
      ii. John H. Wilkes
      iii. William D. Wilkes
iv. Mary J. Wilkes – she married a Mr. Tucker.
      v. Sarah G. Wilkes -
      vi. Ann Wilkes
      vii. Bettie Wilkes
      viii. Amanda J. Wilkes -

    C. Martha Cardwell - she might be the daughter of Henry Cardwell, Sr. and Mary Hankla, but more research is needed. She married John Wilkes, brother of Banister Wilkes and husband of Elizabeth Cardwell, on September 22, 1817 in Halifax County, Virginia.

3. Elizabeth Cardwell – She was the daughter of Thomas Cardwell and Obedience Threatt. She was born prior to 1789 in Dinwiddie County, VA. I have no other information concerning Elizabeth.

4. Jane Cardwell – died in 1798 in Dinwiddie County, Virginia. In her will she mentions her mother, Obedience Cardwell, and appoints Henry Thweatt as her executor. It appears that she did not marry or have any children.

5. Thomas Cardwell – He married Mary Palmer, the daughter of Jeffery Palmer, on December 22, 1795 in Halifax County, Virginia. Jeffery Palmer died in 1818 and in his will he mentions, among others, his granddaughters Susanna and Obedience Cardwell. Thomas Cardwell was dead by November 22, 1815 when his daughter Obedience Cardwell marries William Stow in Halifax County, Virginia. “Polly”, the widow of Thomas Cardwell, gives consent for the marriage. It is possible that Thomas Cardwell is the oldest child of Thomas Cardwell and Obedience Thweatt as he is not listed in the Dinwiddie County Estate Records. More research is needed on this line and it has been included for research purposes only. Numerous researchers have placed this "Thomas" in the family of Thomas Cardwell and Obedience Thweatt, but I have not found any documentation to support that claim other than Thomas Cardwell being listed on the will of Jane Cardwell in 1798. The fact that one of his daughters is named Obedience follows common naming trends of this family. It is possible that he is one of the older children of Daniel Cardwell and Obedience (Last Name Unknown) of Charlotte County, VA. Thomas Cardwell and Mary Palmer had the following children:

    A. Susanna (Susan) Cardwell – she married Thomas Conner on May 1, 1822 in Halifax County, Virginia.
    B. Obedience Cardwell - she married William Stow on November 22, 1815 in Halifax County, Virginia.
    C. Nancy R. Cardwell - born about 1808 in Halifax County, VA. She married William Alexander Gildwell in 1830 in Halifax County, VA. He was born about 1805. They had the follwoing children:

      i. John H. Glidwell - born about 1831 in Halifax County, VA. No additional information.
ii. Henry Thomas Glidwell - born about 1833 in Halifax County, VA. No additional information.
iii. William Elisha Glidwell - born about 1839 in Halifax County, VA. No additional information,
iv. Mary Cornelia Glidwell - born about 1831 in Halifax County, VA. No additional information.

Giles M. Cardwell - Unknown - according to the 1850 Halifax County, VA census he was born about 1782 in Virginia. He appears to have married Frances “Fanny” Moore on 05 February 1808 in Halifax County, Virginia. It has not been determined how Giles fits into the Cardwell family, but the given name of Giles is passed down with frequency in the Thweatt family. He may be the son of Obedience Thweatt and Thomas Cardwell. His year of birth, which is listed as 1782 in the 1850 census of Halifax County, suggests that he was a minor child at the time of this fathers death. He is not listed in the court procedings in the late 1780s that list the minor children of Thomas Cardwell and Obedience Thweatt. In the will of Obedience Cardwell, she is reported to have left the bulk of her estate to her son, Giles M. Cardwell. I have not actually viewed this will, but once it is confirmed then I will add Giles M. Cardwell to the list of known children of Thomas & Obedience. Giles Cardwell appears to have had the following children, but additional research is needed.

    A. Thomas T. Cardwell - Possible - born around 1810-15 in Halifax County, VA. He married Susan H. Street on 21 June 1836 in Halifax County, Virginia. They are listed in the 1850 Madison County, Tennessee census records. Thomas’ younger brother, William A. Cardwell, is living with them in that record. They are listed in the 1860 Madison County, Tennessee census records. Susan died after the 1860 census and Thomas remarried to Cynthia Jones on 02 October 1863 in Hardeman County, Tennessee. She was born about 1852 in Tennessee. It is unconfirmed that Thomas T. Cardwell is the son of Giles M. Cardwell and he is listed here for research purposes only. Additional research is needed. Thomas was the father of the following children:

      i. William G. Cardwell - born about 1838 in Madison County, Tennessee. He is listed in the home of his parents, Thomas T. Cardwell and Susan Street,  in the 1850 and 1860 Madison County, Tennessee census records. He married Joannah Dew on 04 May 1860 in Madison County, Tennessee. William was Killed In Action during the Battle of Shiloh on 06 April 1862.

She is listed in the home of her parents in the 1870 Madison County, Tennessee census records. She married William Merritt Oakes on 07 December 1876 in Madison County, Tennessee. She is named after her maternal grandmother. Rhoda died on 02 December 1926 in Denver, Colorado.

iv. John Thomas Cardwell - born about 1864 in Madison County, Tennessee. He is the son of Thomas T. Cardwell and Cynthia Jones. There is an interesting family listed in the 1900 Hardeman County, Tennessee census. Emma? Cardwell, a widow, is listed with several children. She was born in March 1868 in Tennessee. It has not been determined that John Thomas Cardwell was her husband and they are listed here for research purposes only. Additional research is needed. Children of Emma LNU Cardwell.

        a. Ollie Cardwell - born in October 1883 in Tennessee. She is listed in the home of her widowed mother in the 1900 Hardeman County, Tennessee census records. She married John P. Knight in May 1911 in Hardeman County, Tennessee. No additional informaion.

        b. Anna/Alma Cardwell - born in September 1884 in Tennessee. She is listed in the home of her widowed mother in the 1900 Hardeman County, Tennessee census records. Additional research is needed.

        c. Edgar Cardwell - born in August 1886 in Tennessee. He is listed in the home of his widowed mother in the 1900 Hardeman County, Tennessee census records. Edgar was killed by gun shot wound in Memphis, Tennessee on 15 November 1909. His body was shipped to Jackson, Madison County, Tennessee and he was buried at the Hollywood Cemetery in that county. There may be additional Cardwell ancestors that lived in Halifax County, VA that belong to this line. More research is needed.

From The Southside Virginia, Volume 7, January 1989, page 19: Obedience(4) Thweatt. (Henry(3), Henry(2), James(1)) married in 1767 Thomas Cardwell of Dinwiddie Co., probably a descendant of Thomas Cardwell who owned 350 acres in Henrico Co. at the time of the 1704 quit rent roll. Thomas Cardwell of Dinwiddie died prior to 1782 according to the tax lists. In 1788 his children brought suit against their mother and Henry Thweatt as administrators of his estate. Listed in the suit were: William(5) Henry(5), Jane(5), Thomas(5) and Elizabeth(5) Cardwell. Obediencr- Cardwell last appears on the Dinwiddle tax lists in 1795. She moved to Halifax Co. where she is said to have married secondly her brother in-law Daniel Cardwell and died on 25 Nov. 1822. The will of her daughter Jane(5) Cardwell, dated 3 Jan. 1795, was recorded in Dinwiddie Co. In Feb. 1798. She mentioned her mother Obedience end appointed Henry Thweatt executor. Witnesses were William and Thomas Cardwell. (Some Wills From the Burned Counties of Virginla, Y.L. Hopklns, 1987, p. 26). Of the other Cardwell children, only Thomas(5), is traced. His Halifax Co. marriage to Mary, the daughter of Jeffery Palmer, was dated 22 Dec. 1795. The 1818 Halifax Co. will of her father mentioned among others. grand-daughters Susanna(6) and Obedience(6) Cardwell. Thomas(5) Cardwell was dead by 22 Nov. 1815 when the Halifax Co. marriage of hi daughter Obedience(6) to William Stowe was recorded, his widow Polly giving her consent.

Henry Thweatt(3), (Henry(2), James(l)) lived in Dinwiddle Co. where the tax records list his death in 1795. The name of his wife is unknown, but the frequent use of the name Giles along the descendants of this Henry suggests that she may be a member of that family. A William Glles left a will in Henrico Co. in 1692 and William and Mary Giles were among the early settler of Amelia Co. Henry Thweatt's niece Ann Thweatt Povell wrote in 1877 that all the sons except one. of Henry, who she called Uncle Hal, moved to Halifax Co. (Silas , p. 147). Henry was the father of Obedience Thweatt.

This branch has received some of the poorest research concerning the Cardwell family. Allen Pendergraft made numerous assuptions on this line and his work has made its way into various databases, which include the LDS archives and numerous online sources that site his information as fact. It is not! Please research the line before jumping to the conclusion that were published by Mr. Pendgergraft.
